Guest Spotlight: US Immigration Department to Implement Mandatory Registration and Fingerprinting for Certain Noncitizens Starting March 2025 – By: Vincent Lau, Managing Partner at Clark Lau LLC
On March 12, 2025, the US Department of Homeland Security (DHS) will be publishing an Interim Final Rule (IFR) which will take effect within 30 days requiring individuals to register their presence and provide fingerprints if they are in the US for 30 days or more. Failure to do so could lead to criminal consequences.
Individuals in the US are reminded to do the following:
- Register and provide fingerprints; and
- Carry evidence of compliance if one is age 18 or over; and
- Notify the DHS in writing of each change of address within 10 days of moving.
Individuals who are in possession of the following documents, among others, would have already complied with the registration and fingerprinting requirements:
- Form I-94, Arrival-Departure Record;
- Form I-185, Nonresident Alien Canadian Border Crossing Card;
- Form I-186, Nonresident Alien Mexican Border Crossing Card;
- Form I-551, Permanent Resident Card (a/k/a green card);
- Form I-766, Employment Authorization Document (EAD);
- Valid, unexpired nonimmigrant DHS admission or parole stamp in a foreign passport.
Note: Canadians entering the US for business purposes for 30 days or more, must take action to register if they have not been issued a Form I-94. Also, those children in the US as nonimmigrants must register and appear for fingerprinting within 30 days of turning 14. DHS is working on a way for individuals to register.
