New Intra-company Transfer Work Permit Rules
IRCC’s recent changes to intracompany transfer (ICT) work permits have introduced stricter eligibility and documentation requirements, particularly in the general ICT category (as opposed to the free trade agreement categories). Only established multinationals with existing international operations now qualify, and employers must demonstrate that specialized knowledge is both proprietary and uncommon. Applications must also confirm the temporary nature of the assignment, with the employee’s foreign position remaining available, and prove that the Canadian entity exercises real control and requires the employee’s presence in Canada. These measures highlight the need for carefully prepared, well-supported applications to ensure approval.
